By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, you may not use our Services.

1. Services Provided

Fusion Hosting provides hosting solutions, including but not limited to web hosting, domain registration, virtual servers, and related support. Specific details of the Services you purchase will be outlined in your Service Agreement.

2. Eligibility

To use our Services, you must:

• Be at least 18 years old or the age of majority in your jurisdiction.
• Provide accurate and complete information during registration.
• Agree to comply with all applicable laws and regulations.

3. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials. Any activity conducted through your account is your responsibility. Notify us immediately of any unauthorized use or security breaches.

4. Acceptable Use

You agree to use our Services only for lawful purposes. Prohibited activities include, but are not limited to:

• Hosting, transmitting, or distributing illegal content.
• Engaging in spamming, phishing, or other fraudulent activities.
• Using the Services to harm, harass, or exploit others.

Fusion Hosting reserves the right to suspend or terminate accounts found in violation of this section.

5. Payment and Billing

• Fees for Services are due as specified in your invoice or Service Agreement.
• Late payments may result in suspension or termination of Services.
• All fees are non-refundable unless explicitly stated otherwise in writing.

6. Service Availability

We strive to provide reliable and uninterrupted Services but cannot guarantee 100% uptime. Scheduled maintenance and unforeseen technical issues may result in temporary downtime. Fusion Hosting is not liable for any losses caused by such interruptions.

7. Termination

Fusion Hosting may terminate or suspend your account for:

• Violations of these Terms.
• Non-payment of fees.
• Any activity deemed harmful to Fusion Hosting or its customers.

You may terminate your Services at any time by either providing written notice or cancelling it from the dashboard. Termination does not absolve you of any outstanding payments.

8. Limitation of Liability

Fusion Hosting is not liable for:

• Indirect, incidental, or consequential damages.
• Loss of data, profits, or revenue.
• Claims resulting from your use of third-party software or services.

Our liability is limited to the amount paid by you for the Services during the 12 months prior to the claim.

9. Indemnification

You agree to indemnify and hold harmless Fusion Hosting, its employees, affiliates, and agents from any claims, liabilities, or expenses arising from:

• Your use of the Services.
• Violations of these Terms.
• Infringement of third-party rights.

10. Intellectual Property

All intellectual property related to the Services is owned by Fusion Hosting or its licensors. You may not copy, modify, or distribute our intellectual property without prior written consent.

These Terms are governed by and construed in accordance with the laws of the State of California and the federal laws of the United States. Any disputes will be resolved exclusively in the courts located in California.
